Terms of Service for GaraBrick™

1. Introduction

Welcome to GaraBrick™. These Terms of Service govern your use of our Shopify store (https://www.garabrick.com) and all purchases made through it. By accessing or using our site, you agree to comply with these terms.

2. Eligibility

  • You must be at least 18 years old (or the legal age in your jurisdiction) to make purchases.

  • By placing an order, you confirm that all provided information is accurate and complete.

3. Products & Pricing

  • Product Descriptions: We strive for absolute accuracy in our 1:64 scale dioramas. However, due to monitor settings and the nature of LED photography, we cannot guarantee colors or lighting effects will perfectly match your screen.

  • Minor Variations: Slight color differences or minor structural variations that do not affect functionality are not considered defects. If you request a refund for these reasons, you will be responsible for the return shipping costs.

  • Pricing: All prices are in USD (unless otherwise stated) and are subject to change without notice.

  • Availability: Items like The Tower or limited-edition scenes may sell out. We reserve the right to cancel orders for unavailable products.

4. Orders & Payments

  • Payment Methods: We accept major credit cards, PayPal, and Shopify Payments.

  • Order Confirmation: You will receive an email confirming your order. This is a confirmation of receipt, not a guarantee of fulfillment.

  • Cancellations: You may cancel an order within 24 hours of placement by contacting support@garabrick.com. Please include your order number (e.g., #GB61001) in the subject line.

5. Shipping, Returns & Customs

  • Shipping Times: Estimated delivery dates are not guaranteed. See our Shipping Policy for details.

  • Refund Fees:

    1. Pre-shipment: If you request a refund for personal reasons after 24 hours but before shipping, a 10% processing fee will be deducted to cover platform commissions and admin costs.

    2. Post-receipt: For non-quality-related returns within 30 days, the buyer is responsible for return shipping. Items must be in original, unused condition with all modular parts and packaging intact.

  • Cross-Border Responsibility: All customs clearance procedures, duties, and import VAT are the sole responsibility of the buyer. GaraBrick is not liable for packages held, returned, or taxed by the destination country's customs.

EU Consumer Rights: Per EU Directive 2011/83/EU, residents have a 14-day withdrawal right from the date of receipt. Goods must be unused and in original condition. The buyer bears return costs unless the item is defective.

6. Prohibited Conduct

You agree not to:

  • Use our site for illegal purposes or fraud.

  • Reverse-engineer our modular designs or copy site content.

  • Unauthorized reselling or claiming GaraBrick™ designs as your own.

7. Intellectual Property

All content (logos, modular designs, 3D textures, images) is the property of GaraBrick™ and protected by international copyright laws.

8. Disclaimers & Limitation of Liability

  • Assembly Risk: GaraBrick™ is not liable for damage caused by improper assembly or the use of incorrect power adapters for our LED systems.

  • "As Is" Basis: Products are sold without warranties beyond the initial quality guarantee. We are not liable for indirect or consequential damages (e.g., damage to your diecast cars during display).

9. Indemnification

You agree to compensate GaraBrick™ for any losses resulting from your violation of these terms or misuse of the site.

10. Governing Law

These terms are governed by the laws of USA, without regard to conflict-of-law principles.
